Location-Based Service Terms

Article 1 Purpose

These Location-Based Service Terms govern the rights, obligations, and responsibilities of Sloday Labs (the “Company”) and users in connection with features that use location information in SLODAY (the “Service”).

Article 2 Definitions

1. “Location Information” means information about the place where a mobile object or an individual is or was located at a specific time.
2. “Personal Location Information” means Location Information relating to an identifiable individual.
3. “Actual Location” means the device location recorded when a user logs an emotion or moment, or the location of a place selected directly by the user.
4. “Public Location” means a location adjusted by the Company from the Actual Location to reduce the risk of direct disclosure, or a place the user has directly chosen to make public.
5. “Safe Zone” means an area, such as a home, workplace, or school, that a user designates for exclusion when a Public Location is generated.
6. Terms not defined in these Location-Based Service Terms have the meanings given in applicable location-information laws, the Terms of Service, and the Privacy Policy.

Article 3 Company Information

Article 4 Effect and Amendment of the Terms

1. These Terms take effect when they are posted in the Service or on the website, or otherwise presented to the user, and the user agrees to them.
2. The Company may amend these Terms to the extent permitted by applicable law.
3. If the Company amends these Terms, it will post the effective date and the changes in the Service or on its website at least seven days in advance. An amendment that is adverse or material to users will be posted at least 30 days in advance.
4. A user who does not agree to amended Terms may stop using location-based features or terminate the service agreement.

Article 5 Contents of location-based services

The Company may provide the following location-based services.

1. Saving the location and weather associated with an emotion or moment
2. Ability for users to check their records on a map or timeline
3. Generating a Public Location from the Actual Location
4. Displaying a Public Location on the Finder map, discovery screens, or Nearby when the user makes a record public
5. Ability for users to search for or directly select a specific location and record it
6. Excluding user-designated Safe Zones when generating a Public Location
7. Discovering nearby public emotion records or other public content based on location
8. Using an approximate location inferred from the IP address as the reference point for Nearby when device location is unavailable
9. Other features provided by the Company using Location Information

Article 6 Service usage fees

The Location-Based Services are provided free of charge. Users may still incur data or other telecommunications charges under their carrier’s policies.

Using Slo to view the profile of a Member with whom the user has not yet connected or to send a First Greeting is not a fee for the Location-Based Services. The Actual Location is not disclosed regardless of Slo use, and the same privacy-protection principles apply to Public Locations.

Article 7 Consent to use of location information

1. Before a user first uses a location-based feature, the Company explains the purposes and categories of Location Information used, the purpose and period of retention, any disclosure or provision to third parties, the right to refuse consent, and the resulting limitations, and then obtains the user’s consent.
2. The Company may record evidence of consent, including the time of consent, Terms version, language, platform, and app version.
3. Allowing location access in your operating system does not replace your agreement to these Terms.
4. Users who do not consent to the use of Location Information may still use Service features that do not require location.
5. If you do not agree to the use of location information or do not allow location permissions in the operating system, some functions, such as location and weather records, maps, nearby records, and place search, may be restricted.
6. The Company processes location information to the extent necessary when the user uses location-based features, and does not continuously track or store the user's movement path while the service is in the background.

Article 8 Location information processed and purpose of use

The Company does not use Location Information beyond the purposes stated above. If a purpose changes, the Company will provide the notice and obtain the consent required by applicable law.

Article 9 Distinction between actual location and public location

1. As a rule, the Actual Location is used only to let the user who created a record review that record and is not displayed directly to other users.
2. If you make your records public, the Company may display your public location adjusted based on your actual location to other users.
3. When creating public locations, the Company may take into account the safe zones you have established.
4. Public Location is intended to reduce the likelihood of direct exposure of the Actual Location, but it does not guarantee that the location cannot be identified or inferred again.
5. If a user directly selects a specific location, the coordinates of the selected location may be used for both the actual location and the public location. In this case, the place name and location may be displayed to other users.
6. The Company prompts users to review the potential disclosures described above before selecting a specific place or making a record public.
7. A user may stop displaying a record’s Public Location by making the record private or deleting it.
8. Finder Map annotations display public locations only if the user's latest vibe is public and has not expired. After opening an annotation, expired vibes of the same user can also be viewed with a public location if they are public.
9. Only users whose latest vibes are open/unexpired and who have a public location to use on the Finder map can use Finder, the messaging function, and viewing other users' vibes/profiles.
10. Even if another user uses Slo to obtain profile-viewing access, no additional Actual Location information is disclosed. Only the privacy-protected Public Location of a public Vibe may be shown according to the Relationship Stage and visibility settings.

Article 10 Retention period and destruction of location information

1. The actual location, public location, place, and weather information included in the emotion record is retained to provide record, timeline, and map services for the user while the record is kept.
2. Safe Zone information is retained until the user deletes the Safe Zone or terminates the service agreement.
3. When the purpose of processing Location Information has been fulfilled or the user withdraws consent, the Company destroys the Location Information without undue delay, except for records that must be retained under applicable law.
4. Destroyed location information is deleted in a technically feasible way so that it cannot be recovered or reproduced.
5. Records confirming the use or provision of Location Information may include the creation or modification of a location-bearing record, the start or end of Public Location disclosure, the purpose of use, the processing time, and other details needed for verification. The Company retains these records for six months to comply with applicable recordkeeping obligations and address disputes, and then destroys them.
6. If storage is required in accordance with other laws or if the user separately consents to additional retention of location information, the basis and period are clearly distinguished and stored. The retention period of personal location information based on separate consent does not exceed the period permitted by relevant laws and regulations.
7. Backup data may be difficult to delete individually immediately, and is destroyed sequentially according to the retention cycle with limited access.

Article 11 Provision and disclosure of location information to other users

1. When a user makes an emotion record public, other users may see its Public Location, place name, place category, public address, weather at the time of recording, and a notice explaining that the Public Location has been adjusted from the Actual Location.
2. The public status of each emotional record is independent, and if the record remains public even after expiration, it can be displayed in the Vibe archive and public Vibe viewing screen.
3. In principle, the actual location is not provided to other users. However, if a user directly selects a specific location, the coordinates of that location may be used as a public location.
4. Users can withdraw their consent to the disclosure of records or change their records to private.
5. If the Company offers a feature that provides Personal Location Information to a third party designated by the user, it will identify the recipient and purpose in advance and obtain separate consent.
6. When notice of a third-party provision of Personal Location Information is required, the Company notifies the user of the recipient, date and time, and purpose by the method prescribed by applicable law. Separate consent is obtained before providing consolidated notices.
7. If a related agency, such as an investigative agency, requests location information through legal procedures in accordance with the law, the Company may provide it to the extent permitted by the applicable law.

Article 12 Use of external services

1. The Company may use the functionality of external service providers, such as Apple, Google, and Cloudflare, for map display, place search, weather lookup, or IP-based approximate location.
2. In this process, location information, place-search terms, an IP address, or an approximate region inferred from the IP address may be transmitted to or processed on the network of the relevant provider.
3. Information processed by an external provider may also be subject to that provider’s terms of service and privacy policy.
4. The SLODAY Privacy Policy describes the relevant processing arrangements and overseas transfers in detail.

Article 13 User Rights

Users may exercise the following rights at any time:

1. Withdrawal of all or part of consent to use or provision of location information
2. Request for temporary suspension of use or provision of location information
3. Request access to or notice of records confirming the use or provision of the user’s Location Information
4. Request correction of errors in those confirmation records
5. Request to view or be notified of the reason and contents of your location information provided to a third party
6. Deletion of records or safe areas containing locations
7. Terminate the service agreement
8. Users can exercise their rights through the app's location permission settings, history privacy settings, history and safe zone deletion functions, or [email protected].

Article 14 Protection measures for location information

1. Minimization of location information handlers and access rights
2. Management of records for granting, changing, and deleting location information access rights
3. Protective measures in the process of transmitting and storing location information
4. Automatically recording and retaining records of Location Information use and provision
5. Prevention of forgery and alteration of access records
6. Inspection and protective measures for location information processing system
7. Regular training for location information handlers

Article 15 Person in Charge of Location Information Management

The Company designates a person responsible for location information management to oversee the proper management and protection of location information and to handle user complaints.

Article 16 Changes to or Suspension of the Service

1. The Company may restrict, change or temporarily suspend all or part of the location-based service in the event of system inspection, replacement or failure, communication network or external map or weather service failure, force majeure such as natural disaster, laws or orders from relevant agencies, or other serious reasons for service operation.
2. The Company may notify you in advance in the case of a foreseeable interruption, or after the fact in the case of an emergency or unavoidable interruption.

Article 17 Suspension and closure of business

1. If the Company suspends or closes all or part of its Location-Based Service business, it will complete the filings and user-notification procedures required by applicable law.
2. The Company announces the suspension or closure, the relevant date, and user-protection measures through the Service or its website.
3. In the event of business closure, personal location information and data confirming the use and provision of location information held by the Company will be destroyed in accordance with relevant laws and the necessary proof of destruction will be kept.
4. If there is information that must be preserved in accordance with relevant laws, such information will be stored separately from other information and destroyed after the statutory retention period.

Article 18 Damages

1. If the Company causes damage to a user by violating applicable location-information law, the Company may be liable for damages under that law.
2. The Company is liable under applicable law unless it proves that it acted without intent or negligence.
3. A user who causes damage to the Company by violating these Terms or applicable law is liable to the extent attributable to that user.

Article 19 Dispute Resolution and Governing Law

1. If a dispute arises regarding location information, the Company and the user will negotiate in good faith to resolve it amicably.
2. If the dispute is not resolved through consultation, the user may apply for adjudication by the Korea Media and Communications Commission or mediation by the Personal Information Dispute Mediation Committee in accordance with applicable law.
3. If a lawsuit is filed, the court of jurisdiction will be determined in accordance with relevant laws and regulations.
4. These Location-Based Service Terms are governed by and construed in accordance with the laws of the Republic of Korea.
